I Was Hit by an Uninsured Driver in Florence - Now What?

South Carolina law requires that all licensed motorists have liability insurance to pay for damages in the event of an auto accident. The policy must cover $25,000 per passenger, and $50,000 per accident. Of course, this doesn’t stop some individuals from driving without insurance illegally, or insured drivers from leaving the scene of an accident. Additionally, motorists from out of state may have lower liability coverage than is required in South Carolina. For these reasons, uninsured motorist coverage is also required in all SC insurance policies. You can look at your auto policy and see where is covers you in the event of an accident with an uninsured motorist.

Uninsured Motorist Insurance

While some may be reluctant to file a claim with their insurance company, your uninsured motorist insurance is a safeguard against wrecks where others are at fault, but you’re left holding the bill for damages and injury. While sueing the uninsured party is certainly a possibility, it is often the case that if they were unable to purchase liability insurance in the first place, you are unlikely to receive adequate compensation to cover expenses.

Consequences of Driving Without Auto Insurance

Drivers guilty of operating an automobile that they own can have their license and registration privileges suspended until a fine of $550 is paid in full. They may also have to provide an SR-22 form for three years, starting on the date of the suspension. There have also been instances of drivers compensating the other party in the collision for damages as a requirement for having their driving privileges reinstated.
